If You Paid Overdraft Fees to NBT Bank, N.A., You May be Eligible for a Payment from a Class Action Settlement.1
June 30, 2014 UPDATE: On June 27, 2014, Judge John F. Lambert granted final approval to the Settlement and issued a Final Approval Order and Final Judgment. If no appeals are filed, payments will be mailed to qualifying Settlement Class Members no later than September 3, 2014.
The purpose of this website is to inform you about a proposed settlement of this class action lawsuit and about all of your options before the Court decides whether to give Final Approval to the Settlement. This website explains the lawsuit, the Settlement, your legal rights, what benefits are available, who may be eligible for those benefits, and how to get them.
A $625,000 Settlement has been reached in a class action about the order in which NBT Bank posted Debit Card Transactions to certain customer Accounts during the period September 12, 2005 through September 11, 2011.
The complaint in the lawsuit is posted on this website and contains the allegations and claims asserted against NBT Bank. NBT Bank maintains that the sequence of its posting of Debit Card Transactions is entirely proper and permitted by law.
You are a member of the Settlement Class if you (a) have or had an NBT Bank consumer checking Account that was opened and accessible with an NBT Bank debit card between September 12, 2005 and September 11, 2011; and (b) were assessed two or more Overdraft Fees on one or more calendar days during that period, provided that at least one EFT Transaction occurred in such Account on the same day or days.
Settlement Class Members will receive their payments by check, but only after the Court grants Final Approval to the Settlement and after any appeals are resolved. If there are appeals, resolving them can take time. Please be patient.
Settlement Class Members do not need to do anything to receive their payments.
